Terms of Service

These terms explain the rules for using the AKAI Solutions website, our articles and our free consultations. We've kept them as clear and fair as possible — client projects are always covered by a separate written agreement.
Last updated
The short version

Use the site respectfully

No misuse, spam, scraping at scale or attempts to break our systems.

Content is general guidance

Articles and examples are informational, not professional advice or guarantees.

Projects need a signed agreement

Free consultations and quotes don't create a client relationship on their own.

Alberta law applies

These terms are governed by the laws of Alberta and Canada.

1.Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of akaisolutions.ca and related pages, content, tools and communications (the "Site") operated by AKAI Solutions ("AKAI", "we", "us" or "our") of Calgary, Alberta, Canada.

By using the Site, you agree to these Terms and to our Privacy Policy. If you are using the Site on behalf of an organization, you confirm you are authorized to accept these Terms for it. If you do not agree, please do not use the Site.

2.Consultations, proposals and client engagements

The Site describes the IT consulting, implementation and support services we offer. Nothing on the Site is an offer that becomes binding when accepted.

  • Free consultations: are informational conversations. They do not create a client relationship, and any recommendations are preliminary until confirmed in writing.
  • Proposals and quotes: are valid for the period stated in them (or 30 days if none is stated) and may change if scope, requirements or third-party pricing change.
  • Client work: is governed by a separate written agreement, statement of work or signed proposal. If that agreement conflicts with these Terms, the agreement prevails for the services it covers.

3.Acceptable use of the Site

You agree to use the Site lawfully and respectfully. You must not:

  • use the Site in a way that violates any applicable law or regulation, or infringes anyone's rights;
  • attempt to gain unauthorized access to the Site, our systems or other users' information;
  • introduce malware, run vulnerability scans or load tests, or interfere with the Site's operation;
  • submit false, misleading, abusive, harassing or spam content through forms, bookings or chat;
  • scrape, copy or harvest content or data at scale, including to train commercial AI models, except as permitted by our robots.txt and llms.txt guidance for search and answer engines; or
  • impersonate AKAI or any person, or misrepresent your affiliation with anyone.

We may restrict or block access to anyone who violates these Terms. If you believe you have found a security vulnerability, please report it responsibly to info@akaisolutions.ca instead of testing it further.

4.Blog articles and informational content

Our articles, guides, checklists, pricing ranges and other content are provided for general information only. They are not legal, tax, accounting, financial, cybersecurity or other professional advice, and they may not reflect the latest developments or your specific circumstances.

Examples and results: case studies, scenarios and statistics are included to illustrate what is possible. Some examples are anonymized, composite or illustrative, and industry figures come from typical ranges rather than guarantees. Your results will depend on your business, data, tools and adoption.

Before acting on any information, consult a qualified professional. Privacy, employment and tax obligations in particular vary by organization and jurisdiction.

5.AI chat assistant

The Site includes an automated AI chat assistant to help answer questions. Its responses are generated automatically, may contain errors, and are not professional advice, a quote or a binding commitment by AKAI. Do not rely on chat responses for important decisions without confirming with our team, and do not share confidential or sensitive information in the chat.

6.Third-party products, services and links

We work with and write about third-party platforms such as Salesforce, HubSpot, Zoho, Microsoft, Google, Odoo, Anthropic, OpenAI, Zapier and others. These names and logos are trademarks of their respective owners. Unless expressly stated, AKAI is independent and is not affiliated with, endorsed by or sponsored by these companies.

Third-party products are provided under their own terms, pricing and privacy policies, which you are responsible for reviewing. Links and embedded tools (such as calendars, maps and chat) are provided for convenience; we are not responsible for third-party websites, content or services.

7.Intellectual property

The Site and its content — including text, graphics, logos, page designs and code — are owned by AKAI or our licensors and are protected by Canadian and international copyright and trademark laws. Certain illustrations and icons are licensed from third parties such as Freepik, PNGTree and Flaticon.

You may view the Site and share links to our pages. You may quote short excerpts of our articles with clear attribution and a link to the original page. Any other copying, republication, modification or commercial use requires our prior written permission.

8.Information and feedback you send us

You are responsible for the information you submit through forms, bookings, chat or email, and you confirm you have the right to share it. Please don't send confidential business information until an engagement and any required confidentiality terms are in place. If you send ideas or feedback about our Site or services, you allow us to use them without obligation to you. Our handling of personal information is described in our Privacy Policy.

9.Disclaimers

To the fullest extent permitted by law, the Site and its content are provided "as is" and "as available", without warranties or conditions of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components. Nothing in these Terms limits any rights you may have that cannot be limited under applicable consumer protection law.

10.Limitation of liability

To the fullest extent permitted by law, AKAI and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising from or related to your use of, or inability to use, the Site or its content.

Our total liability for any claim related to the Site is limited to one hundred Canadian dollars (CAD $100). Liability for client services is governed exclusively by the applicable client agreement.

11.Indemnity

You agree to indemnify and hold AKAI harmless from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site, to the extent permitted by law.

12.Governing law and disputes

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, without regard to conflict-of-law rules. You agree that the courts located in Calgary, Alberta have jurisdiction over any dispute arising from these Terms or your use of the Site, except where applicable law gives you the right to bring a claim elsewhere. We encourage you to contact us first — most concerns can be resolved quickly and informally.

13.Changes and general terms

We may update these Terms from time to time. The "Last updated" date shows the latest version, and continued use of the Site after changes means you accept the updated Terms.

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy and Legal & Accessibility page, form the entire agreement about your use of the Site.
